Introduction

Welcome to Gender Research DOCC, run by Smart Venice (“we,” “our,” or “us”). These Terms of Use (“Terms”) govern your access to and use of our e-learning platform, website, and any related services (collectively, the “Platform”). Please read these Terms carefully before using the Platform.

By accessing or using the Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms, you should not use the Platform.

Gender Research DOCC provides educational materials and resources designed to support self-paced learning. The content is intended for informational and educational purposes only.

We may update or modify these Terms from time to time. Any changes will take effect when posted on the Platform, and your continued use of the Platform after such changes means you accept the updated Terms.

Eligibility

Our Platform is open to learners who wish to access and benefit from the educational content provided. There are no specific educational, professional, or geographic requirements to use the Platform.

By registering or using the Platform, you agree to:

  • Provide accurate and complete information when creating an account (if applicable);
  • Use the Platform only for personal learning purposes; and
  • Comply with all applicable laws and these Terms of Use.

Gender Research DOCC provides free of charge access to educational materials for learning only. Users are not permitted to use the Platform for commercial purposes.

Account creation and access

To access most features and learning materials on Gender Research DOCC, you may need to create a user account. When creating an account, you agree to:

  • Provide accurate, current, and complete information during registration;
  • Keep your login credentials secure and confidential;
  • Not share your account or allow others to access using your credentials; 
  • Promptly update any information that changes to ensure your account details remain accurate.

You are responsible for all activities that occur under your account. If you believe your account has been compromised, you must notify us immediately at maria.sangiuliano@smartvenice.org.

Accounts are personal and may not be shared, transferred, or used by another individual. Gender Research DOCC reserves the right to suspend or terminate accounts that violate these Terms or are used in a manner that disrupts the operation of the Platform.

From time to time, Gender Research DOCC may offer guest access to specific courses or materials without requiring registration. Such access may be subject to additional conditions, may provide limited functionality, and may be withdrawn at any time without notice.

Access to the Platform and its content is provided solely for personal, non-commercial learning purposes. We may modify, restrict, or discontinue any part of the Platform at any time without prior notice.

User obligations

By using Gender Research DOCC, you agree to use the Platform and its content in a lawful, respectful, and responsible manner. You must not use the Platform in any way that could harm, disable, or impair its operation or interfere with others’ access to it.

In particular, you agree NOT to:

  • Copy, reproduce, distribute, modify, display, or create derivative works from any content on the Platform, except as expressly permitted;
  • Attempt to gain unauthorized access to any part of the Platform, other user accounts, or related systems or networks;
  • Use any automated tools, scripts, or scraping technologies to access or collect information from the Platform;
  • Use the Platform or its content for any commercial purpose or for public display without our prior written consent;
  • Remove, obscure, or alter any copyright, trademark, or other proprietary notices appearing on the Platform or its materials; or
  • Engage in any conduct that violates applicable laws or these Terms.

You are responsible for ensuring that your use of the Platform complies with all applicable local, national, and international laws. Failure to comply with these responsibilities may result in suspension or termination of your access to the Platform.

Intellectual property

All content available on Gender Research DOCC, including but not limited to text, videos, images, graphics, audio, downloadable materials, design, software, and any other resources (collectively, the “Content”), has been developed within Horizon Europe/Erasmus+ EU-funded projects and may be subject to specific intellectual property or licensing conditions as defined by the respective project consortia. In such cases, ownership and permitted uses are governed by the relevant consortium agreements and EU grant provisions. Where applicable, these materials acknowledge EU funding and the contributing partners.

Your use of the Platform does not grant you any ownership or intellectual property rights in the Content or the Platform itself. All rights not expressly granted in these Terms are reserved by Gender Research DOCC and its licensors (EU-funded projects’ partners and external contributors to the courses).

You may access and use the Content solely for your personal, non-commercial learning purposes. Except where explicitly permitted, you must not:

  • Copy, reproduce, modify, translate, distribute, or publicly display any part of the Content;
  • Use the Content for commercial purposes or in any way that competes with Gender Research DOCC; or
  • Remove or alter any copyright, trademark, or other proprietary notices contained in or accompanying the Content.

If you wish to reuse, reproduce, or distribute any material from the Platform beyond the scope expressly permitted, you must obtain prior written authorization from Gender Research DOCC or, where relevant, the respective rights holders or project partners. Requests for authorization can be sent to maria.sangiuliano@smartvenice.org.

Any unauthorized use of the Content may result in termination of your access to the Platform and may violate applicable laws.

Privacy and data protection

The collection and processing of your personal information when you use Gender Research DOCC are governed by our Privacy Policy, which forms an integral part of these Terms of Use. Please read the Privacy Policy carefully to understand how we collect, use, and protect your information in accordance with applicable data protection laws, including the EU General Data Protection Regulation (GDPR).

By using the Platform, you acknowledge and agree to the practices described in our Privacy Policy, including any updates published from time to time.

Disclaimer of warranties

The content and services provided on Gender Research DOCC are offered “as is” and “as available” without any warranties of any kind, either express or implied. Gender Research DOCC makes no representations or warranties regarding:

  • The accuracy, completeness, reliability, or suitability of the content for any purpose;
  • The availability, security, or uninterrupted operation of the Platform;
  • The Platform meeting your specific learning needs or expectations; or
  • The absence of errors, viruses, or other harmful components.

To the fullest extent permitted by law, Gender Research DOCC disclaims all expressed, implied, and statutory warranties.

You acknowledge that your use of the Platform is at your sole risk, and you are solely responsible for any decisions or actions taken based on the information provided through the Platform.

Limitation of liability

To the maximum extent permitted by applicable law, Gender Research DOCC, its partners and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, or loss of opportunity, arising out of or in connection with your use of, or inability to use, the Platform or its content.

In no event shall the total liability of Gender Research DOCC for any claim arising out of or relating to these Terms or your use of the Platform exceed €0, even if advised of the possibility of such damages.

Nothing in these Terms excludes or limits liability where prohibited by law.

By using the Platform, you acknowledge and agree that the disclaimers and limitations of liability set forth in these Terms are fair and reasonable given the nature of the educational services provided.

Termination

Gender Research DOCC may suspend or terminate your access to the Platform, or any part of it, at any time and for any reason, without prior notice. This includes, but is not limited to, cases where:

  • You violate these Terms of Use or any applicable law;
  • Your account information is false, incomplete, or fraudulent;
  • You misuse the Platform or its content; or
  • Maintenance, security, or operational updates require temporary or permanent suspension.

For registered accounts, termination may result in the loss of access to your account and any personalized settings or progress associated with it. For guest access users, Gender Research DOCC may withdraw access to specific courses or materials at any time without notice.

Termination or suspension does not affect rights or obligations that have accrued prior to termination, including any disclaimers, limitations of liability, or intellectual property rights.

Governing law

These Terms of Use, and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims), shall be governed by and construed in accordance with the laws of the Italian Republic, without regard to its conflict of law provisions.

If you are a business user, you agree that the courts of the Italian Republic shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or their subject matter.

If you are a consumer and reside in the European Union, you may bring legal proceedings in the courts of your country of residence, in accordance with Article 18(2) of Regulation (EU) No 1215/2012. Nothing in these Terms affects your rights as a consumer under applicable EU law.

If you access or use the Platform from outside the European Union, you are responsible for compliance with local laws where applicable.
